General provisions

1. The controller of your personal data is MAGIT, UAB (hereinafter – MAGIT), its branches and representative offices, as well as other legal entities engaged by MAGIT in the provision of services and authorised to act on MAGIT's behalf. MAGIT's contact details are published at www.magit.lt.

2. Personal data collected by MAGIT is processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania, the General Data Protection Regulation and other legal acts. All MAGIT employees, representatives and representatives' employees who learn the secret of personal data must keep it confidential even after the end of the employment or contractual relationship.

3. For the processing of personal data, MAGIT may engage data processors and (or), at its own discretion, hire other persons to perform certain functions on MAGIT's behalf. In such cases, MAGIT takes the necessary measures to ensure that such data processors process personal data in compliance with MAGIT's instructions and applicable legal acts, and requires them to implement appropriate personal data security measures. MAGIT will also ensure that the said persons are bound by confidentiality obligations and may not use such information for any other purpose, except to the extent necessary to perform the functions assigned to them.

4. This Privacy Policy sets out the main rules for the collection, accumulation, processing and storage of your personal data and other information related to you, the scope, purposes, sources and recipients of the personal data processed, and other important aspects relating to your use of MAGIT services. It is therefore recommended that you analyse the provisions of this Privacy Policy in detail before starting to use MAGIT services.

5. MAGIT respects the right to the inviolability of private life and makes all reasonably possible efforts to ensure the security and confidentiality of the personal data and other information it processes.

6. You may visit this website without providing any information about yourself; however, if you wish to submit an enquiry and (or) use other services offered by MAGIT, MAGIT will ask you to provide the personal data specified in the system.

7. This Privacy Policy is an annex to your agreement with MAGIT, which enters into force together with the agreement once you have signed it. By visiting the website www.magit.lt (hereinafter – this website) and (or) using the information contained in it and (or) the services provided by MAGIT, you acknowledge and confirm that you have read this Privacy Policy, understood it and agree with it. MAGIT reserves the right to change the provisions of this Privacy Policy at its own discretion; therefore, when visiting this website, you are obliged to make sure each time that you are familiar with the latest version of the Privacy Policy, which applies at the moment of your visit to this website.

Purposes of data processing

8. MAGIT collects and processes your personal data for the following purposes:

8.1. provision of services, conclusion and performance of contracts, accounting of clients and settlements;

8.2. debt management and debt recovery;

8.3. maintaining and administering relationships with clients, dispute prevention and collection of evidence (recording of telephone calls), business correspondence with the client;

8.4. protection and defence of the interests and property of MAGIT and the client (video surveillance on MAGIT premises). Before entering MAGIT premises where video surveillance is carried out, you are informed of the video surveillance by special signs;

8.5. informing the client about services. Personal data is processed for this purpose in order to notify the client of the services provided by MAGIT, their prices and specifics, changes to the contracts concluded with the client and the like, and to send MAGIT system messages and other messages related to the services provided. The data subject confirms that he or she understands that such informational messages are necessary for the provision of services and are not considered direct marketing messages;

8.6. direct marketing, in order to provide the client with offers concerning the services provided by MAGIT;

8.7. other purposes for which MAGIT has the right to process your personal data where you have given your consent, where the data must be processed for MAGIT's legitimate interest, or where MAGIT is obliged to process the data by the relevant legal acts.

9. All of your personal data collected for the stated purposes, except for your name, surname, personal identification number, date of birth and exact residential address, may be processed for the purpose of statistical analysis. For this purpose, personal data is processed in such a way that, once it is included in the scope of the statistical analysis, the identity of specific data subjects cannot be established. The collection of your personal data for the purpose of statistical analysis is based on legitimate interests in analysing, improving and developing the activities carried out. I have been informed that I have the right to object to and refuse the processing of my personal data for such a purpose at any time and in any form by informing MAGIT of my objection or refusal by e-mail at info@magit.lt. However, MAGIT may continue to process the data for statistical purposes if it demonstrates that the data is processed for compelling legitimate reasons which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

10. In all of the cases mentioned above, MAGIT processes personal data only to the extent necessary to achieve the relevant clearly defined and legitimate purposes, having regard to the protection of the data subject's privacy. MAGIT ensures that personal data is processed accurately, fairly and lawfully, in strict compliance with the clear and transparent personal data processing requirements laid down in legal acts.

Scope of data processing

11. The following personal data may be processed for all of the stated purposes:

11.1 name, surname, personal identification number, date of birth, address, e-mail address, telephone number, fax number, payment account number, position held;

11.2. data related to the provision of equipment and (or) services, for example, the service and its order details, information about the equipment purchased and (or) used, the domain (where website hosting services are provided), invoicing, payment details, information about consent and objection to the processing of personal data for direct marketing purposes and its provision to third parties, contact details and related records;

11.3. data generated in the course of using our services, e.g. traffic data – information about service users and the terminal equipment they use, the amount of data sent, the date, time and duration of the start of a connection, the caller's subscriber number, the number of the subscriber receiving the connection, the IP address used by the internet user at the time of the connection, etc. Voicemail or other call recordings may also be stored, but such data is stored only if you have ordered additional recording services;

11.4. data collected using cookies and similar technologies related to browsing on this website and the like;

11.5. recordings of telephone calls when you call MAGIT or answer calls from MAGIT employees;

11.6. video recording data on premises managed by MAGIT.

Data providers

10. Data providers:

10.1. the data subject himself or herself, directly;

10.2. other sources: other service providers, publicly accessible registers, companies managing joint debtor data files (for example, UAB „Creditinfo Lietuva“);

10.3. data generated when you use MAGIT services, contact MAGIT in writing, by telephone or by e-mail, or visit this website, to the extent provided for by applicable legal acts.

Data recipients

11. Data recipients:

11.1. MAGIT service intermediaries (where services are provided using their services), only to the extent necessary to provide the service;

11.2. debt management and recovery companies, lawyers, companies managing joint debtor data files. Only the data of data subjects (debtors) who have failed to fulfil their obligations on time and properly is provided, after a written reminder of the failure to fulfil the obligations has first been given to the data subject and the data protection requirements laid down in legal acts have been duly implemented;

11.3. courts or state institutions at their request, only to the extent necessary for the proper implementation of applicable legal acts or a court decision;

11.4. other entities under an agreement with MAGIT, only where you yourself have given separate consent to this.

12. Data may be transferred to third countries where the provision of your electronic communications service is related to services provided in third countries, or where a third-country partner (correspondent) is engaged in the provision of the service.

13. Please note that if you are more than 30 days late in fulfilling your obligations, MAGIT provides information about your identity, contact details and credit history, i.e. financial and property obligations and their fulfilment, debts and their payment, to the credit bureau UAB “Creditinfo Lietuva” (company code: 111689163, address: A. Goštauto g. 40A, LT 01112 Vilnius, Lithuania, www.manocreditinfo.lt, tel.: (8 5) 2394131). The credit bureau processes and provides your information to third parties (financial institutions, telecommunications companies, insurers, electricity and utility service providers, trading companies, etc.) in pursuit of legitimate interests and purposes – to assess creditworthiness and manage indebtedness. Credit history data is processed for 10 years after the fulfilment of the obligations. You may consult your credit history by contacting the credit bureau directly or by using the Finpass mobile app. You also have the right to request the rectification or erasure of the data, or the restriction of its processing, and the right to object to the processing of the data, as well as the right to data portability. You can find out more about the exercise of these rights and their limitations at www.manocreditinfo.lt. If your rights are violated, you may contact the data protection officer by e-mail at duomenu.apsauga@creditinfo.lt or by the telephone number indicated above, or lodge a complaint with the State Data Protection Inspectorate or a court.

14. By this document you confirm that you have been informed that your data – e-mail address and (or) telephone number – may be processed for direct marketing purposes, and that you have the right to object to and refuse the use of your personal data for such a purpose at any time by informing MAGIT in writing of your objection or refusal by e-mail at info@magit.lt.

15. For direct marketing purposes, data may be transferred to search or social network systems (the option to opt out of data processing is ensured on the websites of those systems). Data is not provided to other persons.

Profiling

16. For direct marketing and statistical analysis purposes, profiling may be carried out using Google, Facebook or other analytics tools.

Data retention periods

17. We store your personal data for no longer than is required by the purposes of the data processing or provided for by legal acts, where they lay down a longer period of data storage. We aim not to store outdated or unnecessary information and to ensure that personal data and other information about clients is kept constantly up to date and accurate.

Processing of minors' personal data

18. A minor under 14 (fourteen) years of age who wishes to use MAGIT services must provide the written consent of his or her representative (father, mother or guardian) regarding the processing of his or her personal data.

Cookie policy

19. MAGIT may use cookies on this website. Cookies are small files sent to the web browser used by a person and stored on the Client's device. Cookies are transferred to a person's computer on the first visit to this website. Later, cookies are used to identify the person's device; they are intended to improve the functionality and use of the website, as well as for analysis purposes, and they facilitate the person's access to this website and the information contained in it.

20. MAGIT monitors the traffic of this website and collects information on how many visitors have visited it, the domain name of the visitors' internet service provider's server, and the like. Such information is collected automatically during a visit to the website. It helps the website operator understand how visitors use the website and makes it possible to improve the services provided by MAGIT.

21. Visitors to this website are presented with a notice about the use of cookies. By clicking the “SUTINKU” (“I AGREE”) button in the information bar, you confirm that you agree and allow the website operator to store cookies on your terminal device (computer, tablet, smartphone, etc.). Your rights

24. You have the following rights:

24.1. The right to know (be informed) about the processing of your personal data.

24.2. The right of access to the data: to receive information on whether MAGIT processes your personal data and, if so, to access the personal data about you processed by MAGIT and to receive information on the sources from which your personal data was collected and what personal data was collected, the purpose for which it is processed and to whom it is or may be provided; to receive a copy of your personal data from MAGIT in accordance with the procedure laid down in applicable legal acts. Upon receiving your written request, MAGIT will, within the time limit laid down in legal acts, provide the requested data in writing or state the reasons for refusing to satisfy such a request. Data may be provided free of charge once per calendar year, but in other cases a fee not exceeding the cost of providing the data may be charged.

24.3. The right to rectification of the data: if the data about you processed by MAGIT is incorrect, incomplete or inaccurate, to contact MAGIT in writing and demand that the incorrect or inaccurate personal data be rectified or that your incomplete personal data be completed, by submitting a request.

24.4. The right to request the destruction of unlawfully or unfairly collected personal data, or the suspension of the processing operations of such personal data, except for storage. MAGIT must immediately and free of charge verify the lawfulness of the personal data processing and, if necessary, destroy the data. Where the personal data processing operations have been suspended at the data subject's request, the personal data must be stored until it is rectified or destroyed.

24.5. The right to be forgotten: to request that the data processing be terminated (the data erased) where the personal data is processed on the basis of the person's consent and the person withdraws that consent, or where the personal data is no longer necessary for the purpose for which it was obtained, or the personal data was processed unlawfully, or the personal data must be erased in compliance with a legal obligation. You must submit a written notice of your objection to the processing of your personal data to MAGIT in person, by post or by electronic means of communication. If your objection is legally justified, MAGIT, having examined the request, will terminate the personal data processing operations, except in the cases established by law.

24.6. The right to restriction of processing: to demand that the data processing be restricted where the data subject contests the accuracy of the data, for a period enabling the data controller to verify the accuracy of the personal data; where the processing of the personal data is unlawful and the data subject opposes the erasure of the data and requests the restriction of its use instead; or where the data controller no longer needs the personal data for the purposes of the processing, but it is required by the data subject for the establishment, exercise or defence of legal claims. The data controller shall inform a data subject whose data processing has been restricted before the restriction of the data processing is lifted.

24.7. The right to data portability.

24.8. The right to object to the processing of your personal data for direct marketing purposes, and to withdraw the consent given at any time without stating the reasons for the objection.

25. Please note that the rights listed above may be restricted or not exercised:

25.1. Where it is necessary to ensure state security or defence;

25.2. Where it is necessary to ensure public order, or the prevention, investigation, detection or prosecution of criminal offences;

25.3. Where it is necessary to ensure important economic or financial interests of the state;

25.4. Where it is necessary to ensure the prevention, investigation and detection of breaches of official or professional ethics;

25.5. Where it is necessary to ensure the protection of the rights and freedoms of the data subject or other persons.

26. To exercise your rights, you may contact MAGIT by submitting a request by post (using the contact details indicated on this website) or by e-mail at info@magit.lt. In the request, the person must clearly state his or her name and surname, and present an identity document or sign the request with an electronic signature.

Use of logos

27. A client using MAGIT services to satisfy business and professional interests agrees that its name and (or) logo may be used by MAGIT for direct marketing purposes (for example, MAGIT indicating that the Client uses the services provided by MAGIT).

Ensuring information security

28. MAGIT's goal is to ensure the greatest possible security of all information received from the Client and from public data files. In order to protect this information against unlawful access, use, copying, accidental or unlawful destruction, alteration or disclosure, as well as against any other unlawful processing, MAGIT uses appropriate legal, administrative, technical and physical security measures.

Final provisions

29. These provisions of the Privacy Policy are governed by the law of the Republic of Lithuania. All disputes arising in connection with these provisions of the Privacy Policy shall be settled by negotiation and, where negotiation fails, in the courts of the Republic of Lithuania.
